1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the Hollr mobile application and related services ("Service") operated by Hollr Group Ltd ("we", "us", "our"), a company registered in England and Wales. By accessing or using Hollr, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Description of Service

Hollr is a loyalty and advocacy platform that connects users ("Locals") with independent businesses. Locals earn Hollrs and rewards by visiting participating businesses and engaging with the platform. The Service is provided free of charge to Locals.

3. Eligibility

You must be at least 13 years old to use Hollr. By using the Service, you represent that you meet this requirement. If you are under 18, you confirm that you have the consent of a parent or guardian to use the Service.

4. User Accounts

Account Creation: To use certain features of Hollr, you must create an account. You agree to provide accurate, current, and complete information during registration and to update this information as necessary.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.

Account Termination: You may delete your account at any time through the app settings. We may suspend or terminate your account if you violate these Terms or engage in fraudulent activity.

5. Loyalty Programme Rules

Earning Hollrs: Hollrs are earned through legitimate visits to participating businesses. You must make a genuine purchase to earn a Hollr. The number of Hollrs required for rewards and point values are set by us and may change at any time.

Rewards: Rewards are provided by participating businesses and are subject to their availability and terms. We reserve the right to modify or discontinue rewards at any time.

No Cash Value: Hollrs, points, and levels have no cash value and cannot be exchanged, transferred, or sold. They are for use within the Hollr platform only.

6. Acceptable Use

You agree not to: create multiple accounts to gain unfair advantage, claim Hollrs without making genuine purchases, manipulate or attempt to manipulate the points or rewards systems, use automated tools or bots to interact with the Service, share your account credentials with others, use the Service for any illegal purpose, or interfere with the operation of the Service.

7. Intellectual Property

The Hollr name, logo, and all related trademarks, designs, and content are owned by Hollr Group Ltd. You may not use our intellectual property without our prior written consent. You retain ownership of any content you submit, but grant us a licence to use it in connection with the Service.

8. Business Accounts

If you register as a business, additional terms may apply. You represent that you have authority to act on behalf of the business and agree to honour rewards earned by Locals through the platform. Separate business terms will be provided upon registration.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We are not responsible for the quality, safety, or legality of goods or services provided by participating businesses.

10. Limitation of Liability

To the maximum extent permitted by law, Hollr Group Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or £100, whichever is greater. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify and hold harmless Hollr Group Ltd and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the app. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms. If you do not agree to the changes, you must stop using the Service.

13. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
